Injuries - Sexual Abuse

What is sexual abuse?
Any sexual activity that occurs between a child and an adult or older child is sexual abuse, and is considered illegal throughout the country. In all fifty states, by law, a child is not old enough to give sexual consent, legally making any sexual activity involving a minor child sexual abuse.

Sexual abuse can happen in many places and many ways. Rape and child molestation, two forms of sexual abuse, can occur in hospitals, hotels, parking lots, mental institutions or college dormitories.

Perpetrators of sexual abuse can be strangers, acquaintances, family members or persons in helping professions, such as counselors, teachers, coaches, priests or residence hall assistants. However, a large number of sexual abuse cases are not reported.

How to Prevent Sexual Abuse
To prevent sexual abuse, parents should teach children about safety, educate themselves about sexual abuse and take steps to reduce their child’s risk. There are some behavioral signs of sexual abuse including sleeping problems, extreme fear of “monsters”, spacing out at odd times, appetite, eating, or stomach problems, mood swings, unexplained fear of certain people or places, an older child regressing to past behaviors, new words for private parts, talking about an older friend, having unexplained money and self-mutilation.

Unexplained pain or physical injuries can also be a sign of sexual abuse. To prevent further sexual abuse it is important that adults trust their instincts and report suspected sexual abuse. Sexual abuse offenders typically do not stop their behavior on their own.

As a victim of sexual abuse, it is important for you to understand that it is not your fault and you are not alone. There are many hotlines, support groups, legal organizations, therapists, professionals and other survivors waiting and dedicated to help you.

If you would like more information regarding the legal issues of sexual abuse, you should contact an experienced lawyer knowledgeable in sexual abuse cases to review your case and help you understand your legal rights and options.

Sexual Abuse Statistics
Sexual abuse is an under-reported crime. Approximately 88% of sexual abuse cases are not reported. Approximately 500,000 cases of sexual abuse involving a minor child are reported annually. About half of these sexual abuse cases are perpetrated by a minor child or teenager.

One misconception about sexual abuse is that child sexual abuse is perpetrated by mentally ill, pedophiliac strangers. In reality, this is actually a rare scenario for sexual abuse. It is estimated that between 70 and 90 percent of occurrences of sexual abuse are perpetrated by someone the child knows. This means that sexual abuse could occur by someone the parents know and trust.

A sexual abuse offender may be related to the child; typically, the sexual abuse offender has easy access to the child someone such as a coach, teacher, babysitter, neighbor, religious leader or neighbor.

Many states have a screening process for these types of professionals which include background checks, personal interviews and fingerprinting requirements in an attempt to prevent sexual abuse.
